Project Description

Epic prepared a desktop assessment report of ecological features for a property in Queensland. The property fell under a Covenant between the property owner and Brisbane City Council and was pursuant to section 97A(3)(b)(i) of the Land Title Act 1994, for the purpose of protecting the native animals and native plants on the Covenant area.

The property owner wished to construct a new car garage on-site and sought advice on a constraints comparison (Covenant versus no Covenant), a description of the likelihood that an Environmental Assessment Report would be required, obligations for maintenance and/or removal of weeds on the property and confirmation that the area of the proposed car garage was subject to applicable local laws.

Analysis of the applicable legislation was completed and a recommendation report provided to the client, clearly outlining their options and the legalities associated with them.
